Communication is
key when filing a law suit. In order
to be successful, both the attorney
and their client must communicate
regularly and with complete honesty. It is the responsibility of the attorney
to keep their client up to date on all legal
proceedings and the progress of their case; however, it is equally as important that the client update
their attorney on their current condition and keep their attorney informed of
any new or prior circumstances that could possibly expose the client to legal
scrutiny or jeopardize the case. Information such as a history of prior injuries, warrants, or arrests can be lethal to a case if they
blind side an attorney during trial. By hiding previous blemishes on their
records, clients often appear devious and deceptive during trial and loose the
favor of the jury. While they can’t
change the past, attorneys can deal with these issues if they are informed of
them and can even work the case around them if they are given adequate notice. Often
times attorneys are able to prohibit the other side from using these facts
against their client and therefore eliminate prejudice against the client for past occurrences not relevant to
the matter at hand. By simply communicating with their attorney honestly,
clients can save themselves a lot of hassle and embarrassment in the end.

Don’t wait to file your claim! Most personal injury claims have a two year statute of limitations but claims against mass transit agencies expire within just six months. This means
that someone who is injured on a
county bus, for instance, would only have 6 months to file a claim for compensation of their injuries against
the corresponding public transportation agency. These time constraints are
regulated by the Tort Claims Act which provides procedural regulations and requirements
when filing a claim against a governmental entity such as a mass transit
agency. As regulated by the Torts Claim Act, you must file a claim with the mass transit agency
before filing a formal complaint
within the court system. It is very important that any person injured in a mass
transit accident be aware of time constraints concerning their claim. Time is
of the essence when it comes to seeking compensation
from any government agency and the procedural requirements are very unforgiving,
even to ignorance. It is the responsibility of the claimant to be informed of
all procedural requirements regarding their claim so the “I didn’t know” excuse
generally won’t cut it when arguing your right to file a claim after the
deadline. However, there are some exceptions to this rule and even if you think
your claim’s statute of limitations has expired, you should seek a consultation with an attorney just to be sure. Laws are
constantly changing and new precedents are constantly being set by other cases
so don’t be afraid to contact an attorney for advice concerning your rights
when filing a claim.

Public transportation is considered a governmental entity with
public access and therefore is within the jurisdiction of the Freedom of Information Act (FOIA). This
Act grants citizens the right to request information from any governmental
agency without a warrant or subpoena. Most public
transportation options such as county buses are usually equipped with video
cameras that record not only the inside of the vehicle but the outside as well.
These tapes may contain key evidence
either supporting or denying a claim
and as such are very important to obtain. For instance, if you are a bus
passenger and there is a collision with another vehicle, video tapes can help
discern who is at fault. Internal recordings can help to prove your injuries
and external video cameras can provide a more accurate depiction of what really
happened. People often have skewed recollections of traumatic events and video tapes offer an unbiased and unaltered
depiction of what happened. Judges, juries, and claims examiners tend to believe
what they can see with their own eyes over the words of others so these tapes
can prove to be invaluable. As a citizen, you have the right to request these
recordings without any legal aid and denying access to them would be a
violation of the Freedom of Information Act. Unlike with other governmental requests,
you should not have to wait a long time to have your request granted because
all federal agencies are required to respond to FOIA requests within 20
business days.

Setting the Scene: You’ve
decided to help the environment and leave your car at home today in order to
take the bus to work. Your minding
your own business, dutifully avoiding eye contact with other passengers, when
all of the sudden, a pickup truck blows through a red light and plows directly
into the side of the bus. All of the passengers are thrown from their seats and
you are tossed into the aisle, breaking your arm and tweaking your neck. After
everyone is rushed to the hospital and you are treated for your injuries, you find out that the teenager
who rammed his brand new truck into the bus has the best airbags available but
the least amount of insurance he can legally get away with. He walks away with
just a few bruises while you and the other bus passengers are left with broken
bones and many insurance battles ahead. After the incident is over you try to
rationalize why you are left with endless medical bills when the entire
accident was the other driver’s fault. Luckily you had the foresight to invest
in underinsured motorist insurance
and today is the day you get to take advantage of your preparedness.

How it works: If your auto-insurance policy includes underinsured motorist insurance, then
you may be able to get additional compensation
for your claim. Even though you weren’t driving your car, your underinsured motorist policy can kick
in to cover any remaining expenses you incurred from your mass transit
accident. California requires all drivers to carry a minimum ratio of 15:30 for
liability policies which means that the insurance of the vehicle at fault will
pay out no more than $15,000 to any individual who sustained injury or up to
$30,000 total for all injuries sustained in the accident. Well, you were on the
bus with ten other people when the truck hit it and $30,000 will not be enough
to compensate everybody. This is
when your underinsured motorist
insurance would kick in and cover the remaining expenses. Even though you
were not at fault in the accident, make sure to check your personal insurance
policies for further compensation when making a claim.

When asked what the difference is
between homeowners and renters insurance, most people would simply cite the eligibility
requirement that to hold a homeowners policy
you must be a homeowner and to hold renters insurance you must be a renter.
While this is true, and quite self-explanatory, it is not the only significant
difference between the two policies. The focus and coverage of both policies
are innately different. Renters insurance focuses on the possessions of the
renter and covers the theft and destruction of items belonging to the policy holder. This means that the
policy covers what’s inside a rented space but not the building itself. A
homeowner’s policy is similar to car insurance as it covers not only the
possessions of the policy holder but also damages to the structure itself. In
addition, homeowner’s insurance also provides liability coverage for all household members whether an incident occurs on or off the
homeowner’s property. This kind of policy provides umbrella coverage to protect you from accidents and negligence
caused by either yourself or any household members. Household members may also
include your pets. For example, if you are running with your dogs at the park and one of them bites a fellow pedestrian causing serious
damage, your homeowner’s policy would cover the incident. Even though the
incident did not occur at your home, you would still be covered because your dog is seen as a household member and
the accident is thought of as an
unforeseen event. Basically, homeowners insurance covers any kind of accident
caused by a household member while also protecting the policy holder from
outside issues such as theft, fire, natural disasters, and any damages to the home.

If you are injured in a slip and fall at the grocery store,
your immediate response is to file a report on your injuries and seek either
compensation or action to prevent further incidents. If the store does not
comply with your requests, the obvious next step is to acquire legal
representation and sue for compensation. This is pretty common practice and
nobody bats an eye at the idea of suing a major corporation or grocery chain.
Yet, if you were to stumble over a cracked step while at your neighbor’s house
and break your arm, your first response would be embarrassment and then
eventually your “neighborly spirit” would guide you in the direction of
absorbing the entire fault for the accident. Isn’t it odd how water on the
floor of a grocery store is so different than decaying cement at a neighbor’s?
Both are property management issues and can cause devastating injuries. Both
could have been prevented with proper care. So why is it that we feel so guilty
and overall awkward when we ask our neighbors to take responsibility for their
negligence? Well, simply put, it’s because it’s easy to put yourself in your
neighbor’s shoes and implement the “Golden Rule”, treat others how you wish to
be treated. This is a rule that has quelled many a schoolyard squabble; however,
in the adult world we have to realize that this rule works both ways. Shouldn’t
your neighbor have been trying equally as hard to compensate you for your
injuries as you were to take the blame for their lack of property maintenance? In
today’s society we have determined that the neighborly thing to do is to turn
the other cheek. Well once you’ve scraped your cheek on your neighbor’s pavement
a time or two, it might be time to change your position on what’s neighborly.
Personally, I think a good neighbor would prevent injuries on their property
with proper maintenance and repair. Granted some accidents are unforeseeable,
but even those are covered in most homeowner insurance policies. Suing your
neighbor isn’t even really suing your neighbor! Most of the time your injuries
are covered by their insurance and they won’t have to pay a dime out of pocket.
By taking legal action, you are not only getting the compensation you deserve,
but are also preventing any other unsuspecting visitor from falling victim to a
perilous step. So stop worrying about saving face at the neighborhood block
party and hold your neighbors accountable for their mistakes.

Medical Payments coverage is not for everybody. If you feel
comfortable with the amount of coverage that your personal health insurance
provides then you may not feel the need to invest in medical payments coverage.
But if you’re like me and enjoy the security of knowing that you have a
secondary insurance policy to take care of your pesky left over medical bills,
then Medical Payments Coverage (Med Pay) is the way to go. Med Pay is
especially beneficial to those of us who have minimal health coverage, whether
it be employer provided or a personal policy. Med Pay can even help pay for
accident related expenses such as funeral expenses, injuries sustained by
passengers, or even dental care as a result of a car accident. Personally, my
favorite part of Med Pay is that it can cover injuries you sustain as a
pedestrian or bicyclist after a car hits you. Obviously I don’t relish the idea
of being hit by a car, but at least I’d be covered if I was! Just today I
driving past a group of bicyclists and thinking about how dangerously (and
annoyingly) close to by lane they were; I bet they had Med Pay. So, in
conclusion, Med Pay is a great way to protect yourself and your family from the
unforeseen happenings of life. Whether it’s minimal health insurance or absurd
hospital bills, Med Pay’s got you covered. Remember sometimes life gives you
lemons, and you have to make lemonade. Sometimes you get hit by a car, and you’ll
really wish you had Med Pay.

There seems to be some confusion as to what separates
uninsured and underinsured motorist insurance, so let me break it down for you.
Uninsured motorist insurance covers you if you get hit by someone without
insurance. Underinsured motorist policies cover you when you get hit by someone
who causes more damage than what their policy covers. So say you’re driving
along and all of the sudden a car pulls out of a shopping center and right into
the side of your car because the lady behind the wheel was too busy drinking
her latte to look both ways as she exited the center. You guys pull over to the
side of the road and exchange information. She’s very apologetic and gives you
all of the contact and insurance information you need with no hassle then
drives off. Well, turns out she has the most minimal coverage policy legal in
the state of California and it won’t cover all of the damage that she caused.
Not to worry though because you invested in an underinsured motorist policy
that covers the difference between the damage the other lady caused and the small
amount her insurance covers. Basically, these policies protect you from having
to pay out of pocket for the damages caused by individuals who lack adequate
insurance. Believe it or not, some people are not as considerate as you and
will in fact leave you with the bill even if they are at fault for all damages.
As of 2012, 14.7% of motorists in California were uninsured. This means that 1
out of 7 vehicles on the road carried no form of insurance. As cliché as it
sounds, it really is better to be safe than sorry; better to pay a higher
insurance premium than to be stuck footing the bill for damages that were not your fault.

An update to keep you informed on personal injury situations.

The Law Offices of Kennith L. Peterson is your local auto accident expert. We service Yorba Linda, Placentia, Anaheim, Tustin, Brea, Fullerton, and surrounding areas. When we meet with clients who have been involved in automobile accidents, one of the first things that we ask our clients is the level of coverage that they have for uninsured / under insured motorists. A good percentage of the time, our clients do not know their policy limits in this regard. We usually have to take a look at the insurance policy to confirm what their coverage is. May times the uninsured / under insured coverage is not at the same level as their liability policy. Many times it is only a 15/30 policy which means that the most that you can claim for an individual is $15,000.00.

We encourage our clients to have the uninsured / under insured coverage to be the same as the limits for their liability portion of their policy. The uninsured / under insured policy is really insurance for monies to be paid directly to the policy holder as opposed to the monies being paid to someone else. Recent studies estimate that as many as 1 in 4 drivers in California are uninsured. That does not take into consideration the number of drivers who are under insured. Under insured means that while a driver has insurance, they do not have adequate insurance to cover the damages that arise when they are involved in an automobile accident. If you take into consideration the uninsured motorists on the road, as well as the under insured motorists, you are probably talking about the majority of the drivers in California. That means that it is very important to carry adequate uninsured / under insured automobile insurance. Our recommendation is to carry a minimum of 100/300 thousand uninsured / under insured policy. However, if you can afford it, the uninsured / under insured policy should be a 250/500 thousand policy or more. If you are carrying a 250/500 thousand policy for uninsured / under insured motorists and you are involved in an automobile accident, there will be at least $250,000.00 available in insurance to cover your medical costs, loss of earnings, and personal injury.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">It is absolutely critical for individuals who are injured and looking for attorneys to look for credible and reputable counsel. If you have been hurt it is important to always tell your treating doctors the truth. It is also important to seek out the doctors who have the best expertise to treat the injury which you have. Usually it is best to receive a referral to a specialist from your family doctor. Find out what you can about the specialist that you are being referred to. It is important that you receive medical care for your personal injury from very competent and credible doctors. Usually Chiropractors are not the first doctor that an injured individual should go to after an accident. If you have already sought out credible and competent legal representation they will assist you in finding the best medical treatment possible. Be cautious of any attorneys who do not want you to use your group medical insurance and instead wish to refer you to their Chiropractor who will provide treatment on a lien basis. Usually the charges are excessive. The treatment may or may not even address the injuries which you have sustained. Usually the insurance companies view this type of care as being litigation driven and questionable. Doctors who are not credible severely damage the dollar value of what would otherwise be a very legitimate claim. If your attorney or any medical provider suggests being anything other than totally credible you need to see someone else. If you are looking for professional, competent representation, from ethical attorneys, look to The Law Offices of Kennith L. <span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; line-height: 115%; mso-ansi-language: EN-US; mso-bidi-language: AR-SA; mso-fareast-font-family: Calibri; mso-fareast-language: EN-US; mso-fareast-theme-font: minor-latin;">I don’t think that insurance companies generally inform their clients adequately about the risk of having inadequate insurance coverage. In California you are legally insured if you have a minimal policy of 15/30 coverage. This gives up to $15,000.00 coverage for a single individual’s claim. It will pay out as much as $30,000.00 for claims from two or more individuals. When you purchase automobile insurance the question that arises is how much insurance do you need. It boils down to what risk an individual is willing to take by purchasing minimal insurance. In a worst case scenario a driver can be involved in an accident that causes millions of dollars in damages. Most insurance’s are not adequate for those types of cases. Studies show that the median award is $28,000.00. This means that while the 15/30 minimal policy is inadequate, a 50/100 policy is usually adequate. However, if you own a house with any significant equity you really should have an umbrella policy that increases the coverage up to one million dollars. We have heard that insurance companies tell their insured’s not to be too concerned because most personal injury firms will only make policy limits demands. I can’t speak for other firms but I know that, depending on the case, we do an asset check before we recommend to our client to make a policy limits demand only. Just recently our firm collected $145,000.00 over the $50,000.00 insurance which the driver had. In that case, even a 100/300 policy would have been inadequate. The defendant owned his home free and clear. He also had significant cash deposits in various accounts. That individual should have had a one million dollar liability policy to have been properly insured. If you have been involved in an accident in the Placentia, Yorba Linda, Anaheim, Fullerton, or Brea area, look to The Law Offices of Kennith L.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; line-height: 115%;">Having adequate automobile insurance is critical. California requires a minimal policy for liability insurance of $15,000.00 for a single claim and at least $30,000.00 for multiple claims. However, some of the most important parts of automobile insurance are not mandated by California law. They are optional. The uninsured/underinsured motorist portion of automobile insurance is optional. This is the insurance that pays out to the insured in the event that the other driver is either uninsured, or underinsured. We suggest that at a minimum the uninsured/underinsured motorist is at least at the same level as the liability insurance portion. One other aspect of automobile insurance that is often overlooked is the portion that provides for medical pay. This is the part of the policy that will reimburse you directly for out-of-pocket medical expenditures. Usually all that is required from your insurance policy is for you to provide copies of the receipts for which you have paid. The other requirement is that the payments relate to medical care caused by an automobile accident. The medical pay portion of your automobile insurance can be very helpful in minimizing the financial burden sometimes caused by medical payments for injuries arising out of an automobile accident. Medical pay policies can range from Two Thousand Dollars on up to One Million Dollars. While a policy for One Million Dollars is probably not needed for medical pay, a policy up to Fifty Thousand Dollars or more may be very helpful.

You're Injured, Now What?

An update to keep you informed on personal injury situations.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">I think that one of the major functions of a personal injury attorney is to keep their client informed as to what is going on in their case. Our offices’ practice is to provide copies of everything that is being mailed out of the office to our client. This means that all of our discovery responses, letters and requests for discovery are being copied to our client. This helps the client understand what is going on. A lot of times the client assumes that nothing is happening if they do not receive some sort of phone call or letter from the attorney. Usually that is not true. By sending copies of everything to the client, that provides the client with some information about what is being done by our office.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">In addition to sending copies of the correspondence that our office sends out, our attorneys like to review their files about every 30 days. If something needs to be done at that time they will go ahead and do it at that time. This keeps the case moving toward a conclusion.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">We encourage our clients to contact us when there has been any type of significant change in their medical condition. This is true whether or not they are getting better or worse. We need to know that. We like to wait until a client has finished treatment before making any dollar demands on the defendant. Once the client has completed their treatment we like to have an opportunity to meet with them and discuss how they are doing and go over their settlement options. We then go ahead and draft a settlement demand letter that is sent to the defendant.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">All clients of The Law Offices of Kennith L. Peterson are kept informed of their case. The cases are advanced as quickly as possible. Reasonable settlement demands are made when treatment has been completed. For competent legal help with regards to personal injury claims, look to the Law Offices of Kennith L. <span style="font-family: "Times New Roman","serif"; font-size: 12pt;">MEDICAL TREATMENT IS IMPORTANT TO YOUR CASE

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">I can’t emphasize enough how important it is for someone having been involved in an accident to receive the necessary medical treatment as quickly as possible. I have received many telephone calls from individuals who have been involved in automobile accidents and are trying to enlist the services of an attorney after they have not been able to settle their claim with the insurance adjuster. Not too surprisingly, little or no medical treatment has usually been obtained by the individual. Insurance companies offer little or nothing for claims where medical treatment was not obtained. The law does provide that someone causing an accident is obliged to not only pay for medical treatment and injuries, but they are also obliged to pay for inconvenience and related costs. Unfortunately, most insurance companies do not view inconvenience as having any value at all. Those same individuals calling and asking for help usually tell me that they have held off going to see a doctor because either they have been too busy, or they do not have insurance. However, they assure me that they are still hurting. It is with regret that I have to tell these callers that I am not able to assist them

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">If you think about it, if you are really hurting from an accident you will seek medical attention. The emergency rooms in California do not refuse treatment to anyone. If you are hurting enough, and don’t have medical insurance, you will go to the emergency room for treatment. Most probably you will also follow-up later on for treatment if necessary.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">If you have been involved in an accident and have sustained serious injuries you need to obtain medical treatment immediately. Make sure you tell the attending doctors and nurses about all of your complaints. If you focus on one of the more serious areas that are hurting you it will be assumed that the other areas don’t exist. The insurance companies will obtain copies of all of your medical records at some point in time and review those very carefully for what complaints you were making at the time that you were first treated. Insurance companies make a big deal of any inconsistencies that they see in these records and what they understand your injuries to be. Make sure that you complain about all of your body parts that have been injured. Make sure that you repeat these complaints to the nurses or therapists who treat you. Usually medical records are made by not only the doctors, but also the nurses and the therapists.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">I do not recommend waiting thirty days or sixty days to contact an attorney after you have been involved in an accident. I recommend that you contact them right after you obtain the initial medical treatment needed to stabilize your medical condition. Don’t give any statements to any insurance people without first contacting your attorney. As soon as you have obtained the services of an attorney advise all of the insurance companies of this.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">If you have been involved in an accident the personal injury attorney’s at the Law Offices of Kennith L. Peterson are here for you. If you live in Placentia, Yorba Linda, Brea, Anaheim, Fullerton, or surrounding area, contact one of the attorney’s at the Law Offices of Kennith L.

<span style="font-family: "Times New Roman","serif"; font-size: 12.0pt;">In a Slip-and-Fall or Trip-and-Fall type of claim it is very important to immediately preserve evidence of what caused the fall. Sometimes a broken step will be the cause of the fall. You need to have a picture of that. Sometimes the cause of the fall is a pothole. You need to get a picture of that. Pictures are sometime the only thing that will allow you to be successful with your claim. Once the injury is reported to the landlord, usually they immediately make corrections or change things where the injury occurred. If there was a pothole, they will fill the pothole. If there was a spilled liquid, that will have been cleaned up. If there was a broken step, that will have been repaired. Fortunately most people carry cell phones that have the capabilities of taking pictures. If you are too injured to take a picture yourself, have a friend, family member, or someone who is passing by to take the picture for you. It is critical to preserve evidence of what caused the injury. You will also need to keep and preserve the shoes that you were wearing at the time of the fall. You should also make note whether or not you were wearing glasses or using any type of cane or similar devise. As soon as you are able you or a family member should call an attorney to assist you in the claim. Usually an expert will be needed to evaluate the claim. Look to your local accident attorney, Kennith L. Peterson, to protect your rights.
